Murmur Terms of Service

These Terms of Service ("Terms") govern your use of the Murmur mobile application ("App" or "Murmur"), operated by Borough AI, Inc. ("we," "us," or "our"). By using Murmur, you agree to these Terms. If you don't agree, please don't use the App.

1. Using Murmur

Eligibility: You must be at least 18 years old to use Murmur. By using the App, you confirm you meet this requirement.

Account: You can sign in with email, Apple, or Google, and you can browse some features anonymously. You're responsible for keeping your account secure and for all activity under it. Provide accurate information, keep your login credentials private, and tell us about any unauthorized use.

2. Acceptable Use

Use Murmur only for lawful purposes. You agree not to:

  • Harass, threaten, or abuse other users, or post hateful, offensive, or illegal content.
  • Impersonate anyone or create fake or misleading accounts.
  • Post false information about events, venues, artists, or organizers.
  • Send spam, including unsolicited or bulk friend invitations or messages.
  • Upload contacts you don't have permission to share.
  • Scrape, copy, hack, overload, or reverse-engineer the App.
  • Use the App for commercial purposes without our permission.
  • Violate others' privacy or intellectual-property rights.

3. Your Content & License

Your content: You may post content such as photos, moments, share cards, profile details, posts, and GIFs ("Your Content"). You keep ownership of Your Content.

License to us: You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute Your Content within the App to operate and promote Murmur. This license ends when you delete Your Content or your account, except for content others have already shared or where retention is required by law.

Your responsibilities: You represent that you have the rights to post Your Content and that it doesn't violate any law or third-party right. You're responsible for the audiences you share with through your visibility settings.

Feedback: If you send us suggestions or ideas, we may use them without any obligation to you.

4. Reporting, Blocking & Moderation

You can block other users and report content or behavior that violates these Terms. We may review, remove, or restrict content, and may suspend or terminate accounts that violate these Terms or harm the community. We're not obligated to monitor all content, and you interact with other users at your own risk.

5. Organizer & Artist Accounts

If you use Murmur as an event organizer or claim an artist profile:

  • You represent that you're authorized to act for that organizer or artist, that the information you post (events, listings, images) is accurate, and that you have the rights to post it.
  • Organizer tools may let you and your team check in attendees at events. You agree to handle attendee and check-in information responsibly, only for running your event, and in line with applicable law.
  • You're responsible for managing your team's roles and permissions.
  • We don't currently process payments or payouts through Murmur; ticket sales happen through third parties (see Section 7).

6. Third-Party Services

Murmur may link to third-party websites and apps, including:

  • Public artist and music pages. Murmur does not connect your personal streaming accounts or access your listening history.
  • Ticketing platforms and venue websites.
  • Maps, ride-hailing, and social-media apps (for sharing).

Each has its own terms and privacy practices that apply when you use them. We're not responsible for third-party services or their content.

7. Tickets & Bookings

Murmur helps you discover events and find tickets, but we don't sell tickets or process payments. When you buy a ticket, you do so directly with the venue or a third-party ticketing platform, and their terms, fees, fulfillment, and refund policies apply. Some links may be affiliate links. Always check the seller's policies before buying.

8. AI Recommendations

Murmur uses AI to provide personalized recommendations based on your taste and activity. These are suggestions, not guarantees. We're not responsible if you don't enjoy a recommended event, and recommendations may not always be accurate or complete.

9. Copyright & DMCA

We respect intellectual-property rights. If you believe content on Murmur infringes your copyright, email hello@murmur.fm with: a description of the work, where the content is located in the App, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement that your notice is accurate. We may remove infringing content and terminate repeat infringers.

10. App Stores

You get Murmur through the Apple App Store or Google Play, and their terms also apply. If you use an Apple device: these Terms are between you and Borough AI, Inc., not Apple; Apple has no obligation to provide support or to address any claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you aren't located in an embargoed country or on a prohibited-party list.

11. Privacy

Your privacy matters. Our Privacy Policy explains how we collect, use, and protect your information, and is part of these Terms.

12. Termination

You can delete your account anytime in the App. We may suspend or terminate accounts that violate these Terms or for other legitimate reasons. Some provisions survive termination, including content licenses already granted to others, disclaimers, and limitations of liability.

13. Disclaimers

Murmur is provided "as is" and "as available" without warranties of any kind. We don't guarantee:

  • Uninterrupted or error-free service.
  • Accuracy of event information (dates, times, venues, and lineups can change).
  • That you'll enjoy recommended events.
  • Availability of tickets for events.

14. Limitation of Liability

To the maximum extent permitted by law, Borough AI, Inc. won't be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of Murmur. Our total liability for any claims relating to Murmur won't exceed $100 or the amount you've paid us in the past 12 months, whichever is greater.

15. Changes to These Terms

We may update these Terms from time to time. We'll notify you of significant changes through the App or by email and update the "Last updated" date. Continued use after changes means you accept the updated Terms.

16. General

These Terms are governed by the laws of the State of Delaware. Any disputes will be resolved through binding arbitration in Delaware, except that either party may bring claims in small-claims court. If any part of these Terms is unenforceable, the rest remains in effect. These Terms and our Privacy Policy are the entire agreement between you and us regarding the App.
